Saleem writes software. Big Company calls Saleem and asks him to write a small piece of software it needs to operate a switch it sells. Saleem agrees over the phone to do it for a Fixed fee of $3,000. Saleem writes the software in his basement, using his own computer, in his own way and delivers it to Big Company. Saleem later sells the same software to another company. Big Company sues Saleem stating that it owns the software and should get the proceeds of the sale. What is most likely? It depends upon whether Saleem was an agent or principal. If an agent, then the software belongs to Big Company, if a principal, than it belongs to Saleem. 2 Saleem was an employee of Big Company and Big Company owns the rights to the software and should get the proceeds..
