The Fair Labor Standards Act states that "An employee who is required to remain on call on the employer's premises is working while "on call." An employee who is required to remain on call at home is not working (in most cases) while on call. Additional constraints on the employee's freedom could require this time to be compensated" (Department of Labor, 2008). The employee is in the office Monday- Friday from 9am-5pm and will be paid for a 40 hour work week. Additionally the employee is required to take calls 24/7 from clients. If there are no restrictions placed on the employee while on-call, compensation would only be necessary when a call is taken. Restrictions such as stay-at-home, no alcohol consumption or staying within a certain radius of business might create a pay obligation to the employee overtime (Fleischer, 2022).
