Therefore, Buddy shouldn't have to pay because it can be considered to be a wager as a joke or something like that since they are friends and it was a verbal promise or a gift for winning the race. I also think that this would fall under a preexisting duty because the driver was hired by the owner of the car to race it, although I am not sure if the sole purpose was to win or if it was to just have someone else drive the car for them."
