How to response this message: "I feel that this situation would fall under the quasi-contracts. The women did not go contract the nursing company to provide her the round the clock care. In fact, the situation even states that the care was contracted at the hospital's request. Since Janine did not seek out the nursing company and contract with them neither written or verbally that she would need their services she can not be held liable to a contract that she did not go into. For a contract to be valid both sides must make promises that must be upheld. Seeing that Janine did not go into this agreement making any promises of payment on her end she did not commit to any payment by verbally agreeing to the terms or signing any papers that would make her liable to payment of services rendered. Since the hospital was the ones that made the request and even contacted the nursing service if anything they should be the ones who are held liable for the contract. This service was at the request of the doctor and after that request was made the hospital then made contact. From the information presented it is hard to see how the nursing company would have a case against Janine. However, if the company would like to purse Janine for the company's services they could go after her based on an implied contract basis. Because she knew about the services and was aware of what they were doing for her they could argue that she is then liable for the contract and in turn must pay for the services rendered."
