Mary Jay says that on august23,2009 she entered into a contract to sell her property at 13456 cresent road in surrey to winnie Bradley. The contract provided that the purchase price would be $845000 and would complete on november13,2009. On september 9,2009, Ms Jay entered into the contract with Douglas and kaye Billy to purchase their property at 1687-140A st in surrey. She was relying on the proceeds of sale from her property to finance her purchase of the Billy property. The completion date for the Billy property was also November13,2009.
Before the sale of the jay property was to complete , mrs Bradley 's real estate agent, who was her husband, Bill Bradley notified Mary jay that winnie would not be able to complete by the completion date. He requested an extension until the end of December 2009, Mary refused to extend the completion date.
Mary's real estate agent then contacted Mr Nickel who had offered to buy the property before the Bradley contract and for a substantially lower amount. Mr Nickel was not willing to make an offer on the property, so Mary relisted the property for $849,000 on november 14,2009. Mr Nickel offered to purchase the property for $630,000, which was refused. He then offered $650,000 which Mary refused. On December 3, 2009, Mary accepted Mr Nickel's offer to purchase the property for $670,000 with a completoin date of December 3, 2009. Mary obtained an extension of the Billy purchase to December5,2009, as well as reduction of the purchase price from $580,000 to $550,000.
Mary says that she behaved reasonably in entering the contract of purchase and sale with Mr. Nickel because she had to close on her contract with the Billys.
Mary says that she is entitled to the difference between the amount she would have received from the defendant on her contract of purchase and sale $845,000 and the amount she received from Mr.Nickel of $670,000 less the sales commission , a net loss of $169,356.25
