I do not think that you can generalize the entire criminal justice system as either compliant with the provisions of the 14th Amendment or not. Every aspect of the criminal justice system - be that in policing, the courts, or corrections - has some level of discretion that can be applied by the individual. Every individual has the responsibility of ensuring that equal protection under the law is granted to every person. Examples can be found of officers or judges who are entirely objective, and others who allow their biases to affect their decisions. It is not the system that creates this disparity, but the people who operate within it. However, I also acknowledge that there are multiple spheres of influence; namely, individual, workgroup, organization, law and regulatory agencies, and culture (Pollock, 2019, p. 81). This is why the right people must be in positions of leadership within the criminal justice system.
Especially in the field of criminal justice, professionals have a responsibility to act with due care, due regard, and/or due diligence. These can all be grouped under the same general definition: "the degree of care that a reasonable person would exercise in a given situation, under similar circumstances" (Content Team, 2017, para. 3). When this standard is not met, individuals can, and should, be held accountable for their negligence. As professionals, we represent more than ourselves; we represent our organization and field. If we cannot do our job with due diligence, providing equal protection under the law for all, then we should not be in a position of leadership. This is especially true for judges, who have significant influence over the lives of others. This idea is Biblically supported. "And he called him, and said unto him, How is it that I hear this of thee? give an account of thy stewardship; for thou mayest be no longer steward" (King James Bible, Luke 16:2).
I believe that I have a Biblical worldview. "The most basic of all worldview presuppositions: what we believe about God" (Liberty University, 2019). Worldviews address the idea of purpose. This comes from understanding where we came from, why we are here, and what happens after this life. I believe that God created us in His image to serve Him and that if we are faithful to Him we can spend eternity by His side. I believe that the Bible is God's word to guide us in this journey. God, through the Bible, provides the moral foundation by which I live my life.
The concept of greater good is a utilitarian principle. Utilitarianism is "the ethical system that claims that the greatest good is that which results in the greatest happiness for the greatest number" (Pollock, 2019, p. 37). This system can take two bad options and justify one as good because it results in a better outcome for the majority. In this dilemma, the choices are to shoot down the plane and kill 310 passengers, or allow the plane to fly into Yankee Stadium, which holds upwards of 45,000 people, killing the plane passengers and many of the stadium occupants. The majority in this scenario are in the stadium, and it is in their best interest to shoot the plane down. Using this reasoning, I justify my decision to order the fighter jets to down the commercial plane. Considering the majority, the passengers of the plane may have come to the same decision. Historically, this has happened before. During the 9/11 attacks, the passengers of Flight 93 chose to take down their plane in Pennsylvania before it could reach the national capital area. Their choice and sacrifice saved countless other lives.
