As you can see from the Kerr/Schneierarticle, robust encryption will continue to present significant challenges to law enforcement for the foreseeable future. Newer cell phones automatically encrypt all data and robust encryption programs seamlessly encrypt files, folders, and entire drives or other storage media. There are strong arguments to be made that the privacy rights and other benefits from strong encryption outweigh the costs the criminal law enforcement. There are equally strong arguments that encryption prevents law enforcement from accessing vital evidence in the societally desirable goal of preventing, deterring, and punishing crime

The assignment is to discuss how law enforcement should address the problems presented by unbreakable encryption. Please comment on the feasibility of the six workarounds or suggest other approaches law enforcement might take. Finally, I would like to hear a view, from a professional perspective, on how society should strike the proper balance between individual privacy rights and the governmental need to collect information for law enforcement, regulatory, and other appropriate purposes.

As an alternative, suggest statutory changes that could be made that would balance privacy rights against the needs of law enforcement. It can discuss requiring backdoors in encryption products; statutes that compel subjects of criminal investigations to disclose passcodes or passphrases;or an escrow system that requires encryption product providers and encrypted device manufacturers to place a master key with an escrow agent; which will provide that key to law enforcement only when served with a search warrant. Assess the feasibility that each proposal has of being enacted into law at either the Federal or State level.
