The Graham case held that judicial decisons about claims of excessive force must be made using the 4th Amendment's "reasonableness standard." They acknolwedged that officer's have to make split second decisions in violent, chaotic, and rapidly evolving circumstances. They even clarified three things officers must weigh in making use of force decisions: severity of the crime, the danger the suspect poses to society, and the suspect's level of resistance or probability of escape. Put yourself in the place of an officer involved in this pursuit. How severe are the crimes the suspect is initially being stopped for? What about the crimes the suspect commits as the pursuit continues? What level of danger does the suspect pose to the public? What level of danger does the suspect pose to the police? What would you say about the level of resistance? Do you think these officers handled this appropriately? Do you think they could or should have done something different? Should they have taken more action at an earlier point in the pursuit?
