The federal trade commission ordered Hudson to dispose of the assets, charging that the acquisition would likely substantially lessen competition or trend to create monopoly in violation of the Clayton Act. Hudson alleged there were new companies that would compete, however because none had won a bid to construct a tank since BT's acquisition, customers were not aware of the new companies, and so Hudson continued to get contracts without bidding.
