Hypothetical Problem
This is a case study
Topic: The law of contract, Fraud ( does silence amounts to fraud?)
A, along with his friend, went to buy a painting from Bengal Art Gallery at Gulshan and also bought a painting thinking it to be a work of Kanak Chapa (famous Bangladeshi artist). While in the gallery A's friend doubts whether the painting is really of Kanak Chapa's considering how can the painting of such a reputed painter be so cheap? He also shared his opinion with A, but eventually they bought it.
The owner of the art gallery knew that the painting was actually by a less reputed painter (in fact a replica of Kanak Chapa's original work) and that they (A and his friend) were making a mistake butmade no comment of any kind. However, while paying the price out of curiosity, A asked the Art Gallery owner's opinion whether the deal is "good value for price", but he (owner of Art Gallery) prefers to remain silent, considering that they have already decided to buy.
Afterwards, A came to know the truth (that the painting does not belong to Kanak Chapa's original art, but only a replica by some other artist) and became angry considering that he is being cheated and sued the owner of the Bengal Art Gallery for damages.
The owner of Bengal Art Gallery came to you and seek your advice, advise him.
