Agency In September 2021, John came up to Smith, who is a sole trader in a real estate agent. John gave Smith instructions to sell his cafe for at least $350 000. John and Smith signed a contract outlining the particulars of this agreement. Smith sold the caf to his son, Tom, for $300 000. Tom sold the caf to Peter for $500 000 and gave Smith $50 000. What action does John have against Smith? Partnership Peter and John live in Sydney, NSW. They have previously travelled to Dubbo, and they have an interest in decent Dubbo coffee. Both wanted to create a decent Dubbo coffee business in Sydney and hoped to make a lot of money from the coffee business. To start the business and get the business run, they need $50,000 in the capital. They are not good in financial history and current economic inflation. They are not able to find an institution to borrow a loan. Jonathan, a friend of Tom, was able to put the capital money if the loan agreement was specifically definite that there was no intention to create a partnership agreement between them. The loan agreement defines that Jonathan has to share profits and loss and access to the partnership financial records, which prove the loan was not to be repayable until after the dissolution of the partnership. Unfortunately, there wasn't much interest in Dubbodecent coffee, and Peter and John were ultimately acknowledged bankrupt. Jonathan, as a friend, had tried to help them save the business in four months before acknowledging bankruptcy. Jonathan had the opportunity to get into a management role, and the 3 ofthem shared knowledge day todayin decisionmaking.Jonathan made a claim as a creditor who was rejected by the trustee in bankruptcy on the foundation that Jonathan was a partner. Is the trustee in bankruptcy correct? Torts and Negligence Jenny went to a beautiful bar to see her friend Jack at 7.30 pm Jenny ordered a white wine, and Jack ordered a glass of red wine. At the same time as Jenny drank her bottle of wine, Jack ordered more and drank four more glasses of red wine. It was getting late, and before midnight, they decided to leave the bar. Jenny was offered life by Jack, and she accepted. Jenny remembered Jack was still on his learner's licence, but they were literally 5minutes up the road, so she was not too concerned about it. After Jack had driven a couple of blocks, Jenny noticed Jack was having trouble keeping the car steady on the road. It was raining outside, and Jenny decided to stay in the car because she did not want to walk home in the rain. The next thing Jenny remembers is sitting on the side of the road in discomfort pain with an ambulance next to her. the ambulance attendant told her that Jack had lost control of the car and hit a tree. Jenny and Jack both were seriously injured. Advise Jenny if she can sue Jack
