I believe that Smith's objection should not prevail. Smith believed that since he is a resident of a different state, Florida court's exercise of personal jurisdiction should not apply to him. Long-arm statutes are in place to extend the state's power to defendants outside of the state therefore Smith's objection should not prevail. Using an ADR method might improve this situation for Smith. He will likely save money using this method rather than going to trial and usually ADR negotiations leave the "losing" side happier than civil trials.
