You act on behalf of a group of women from Ukraine who have come to Australia as spouses of persons with Skilled Working Visas. The continuation of the visa is dependent on them remaining in a permeant relationship with their spouse. If they leave the relationship, they are required to depart Australia. A non-permeant resident who has been subjected to domestic violence may apply to the Department of Immigration for consideration under special circumstances relating to family violence under the Migration Regulations 1984. People who have been the victims of domestic violence may be eligible for another type of visa. Your clients all allege they have been subjected to domestic violence by their spouses and have left the relationship, they are fearful that if they return to Ukraine they will be persecuted. Your clients are currently resident in a Women's Safe House operated by a charity. The Department of Immigration and Boarder Force recently published on their web site the name and current addresses of all women who had pending applications for consideration of an alternative visa on the grounds that their partner had abused them. Information on the web site was available to the public both in Australia and in Ukraine. Advise: Your clients whether there has been any breach of the Privacy Act, 1988 Cth and any remedies available to them
