FACTS:

On July 4th, 2014, John was ticketed for speeding while going 75 mph on a four-lane highway in Nevada. Traffic was moderate, but intermittently light. The weather was sunny, but it had been raining an hour earlier and there were still some puddles of water on the shoulder, but not on the road itself. The road had four moderate turns in it for the 20-mile stretch on which John was driving.

ISSUE:

Accepting the roles as the defender, we will argue John was NOT speeding. Based on this the question is:

Whether John drove within speed limitation and followed traffic rules while driving?

Whether the speed was reasonable by examining the weather, road, and traffic conditions?

RULE:

Under Nevada statute, the speed limit in the state of Nevada is whatever is reasonably safe speed under the circumstances. Neva State Code Section 123.45. Courts determine whether the speed was reasonable by examining the weather, road and traffic conditions. Nevada v. Smith, 1P.2d 56 (Nev. 2020)

ANALOGOUS CASE:

In Nevada v. Smith, a Nevada court held that driving 80 miles per hours was reasonably safe under the circumstances. Smith had been driving on a four-lane highway that was mostly straight with two moderate curves for 30 miles. The weather was bright and sunny and there had been no rain. Traffic on the road was light to intermittently moderate.
