I have read the following events below and was asked to analyze the actions of Florence for lawfulness. (Which I have but would like to see how my answer measures up to your response.)
- Florence, a police officer, arrested Joe for robbing a liquor store. As she handcuffed Joe, he said, "I didn't do this! The person working at the store pointed at me and said I was the robber, but the real robber ran away. He looked a lot like me. But it isn't me, I swear! I was just walking down the street when the robbery happened!"
- Florence read Joe his Miranda rights.
- Florence drove Joe to the jail to be booked, but the trip took 2 hours because of heavy traffic. Joe fell asleep in the backseat of the car, and then woke up as they were almost to the station.
- "You had a nice nap," Florence said. Joe asked, "Where am I?" Florence laughed, "Seriously? You don't know?" Joe said, "All I know is that my next door neighbor is the one who should be in the back of a police car. She sells heroin but no one ever suspects it, because she seems so innocent."
- At the station, the real robber had already been caught, so Joe was released.
- Based on Joe's statement, Florence obtained a warrant to search his neighbor's home, found heroin, and arrested his neighbor.
