1. Can the existing system handle serious, violent, and habitual juveniles adequately?

In my belief it can, a lot of time young offenders can really benefit from rehabilitation and programs. There are certain cases however, the most violent and most serious, that should be treated differently. I think we have created a system where juvenile offenders feel emboldened by the lack of punishment and repercussions which is the reason the rate of recidivism amongst juveniles is so high.

2. Do we need the informal and paternalistic protections offered by the existing juvenile justice system?

The informal adjustment is an important stage in juvenile proceedings.It diverts the child away from the formal judicial proceeding and instead offers ways to provide help and accountability for the child with less formality. It prevents the child from being labeled a juvenile offender. I mention this in my prior question about programs and rehabilitation benefiting juveniles. In my opinion yes, we do still need the informal and paternalistic protections offered currently. It's important to not ruin a juvenile's life so early on in there formidable years. Giving juveniles these rights during the pendency of their case is vitally important.

3. What impact would abolishing the juvenile justice system have on the entire criminal justice process?

Abolishing the juvenile justice system will result in juvenile criminals or offenders to be tried as adults and placed in adult facilities. Studies have shown that the human brain is developmentally immature during the adolescent years. Because of this, juveniles tend to be more impulsive, act before they think, sensational seekers, and more susceptible to peer pressure. Abolishing the juvenile justice system would be a major mistake. It would send juveniles down the wrong path and give them no hope to change their ways/life. Putting juveniles in the same category as adults will be a travesty of justice.

1. I think that our current system handles dangerous, aggressive, and repeat juvenile offenders too lenient. I believe when it comes to holding juveniles accountable, we also need to think of the victims and the communities that are affected by the juveniles. I understand that juveniles brain do not mature until they are in their 20's, but that is no excuse to not hold them properly accountable.

2. I think the current protections can be useful to some degree. It is still a good option to have programs, education and therapy to offer rehabilitation instead of always going for incarceration.

3. I think that if we were to abolish the juvenile justice system, overall would create a dis-service to today's at risk youth. One on hand, juveniles would no longer be afforded some "special" treatments such as programs for rehabilitation, since adults could then argue if its one criminal justice system, they should also be afforded the same treatments as opposed to incarceration. I think the two separate system is good, but I wish it wouldn't be SO lenient at times.
