Theft is a felony FACTS Mark hatched a criminal plan that he thought was foolproof. He decided to read the obituaries in his local Fort Worth, Texas paper every day to then break into the vacant homes of people who had died recently while their families were attending their funeral services. Friday morning's paper reported that Sally Smith, a 78-year-old widow who had been living alone for more than twenty years, had passed away the previous week and that Sally's extended family would be receiving visitors at the Martin Funeral Home from 4-6 p.m. and 7-9 p.m. Friday evening . At 10 p.m. Friday night, Mark used his set of lock picks to unlock the back door to the home that Sally had lived in while she was alive. He spent 20-30 minutes looking for valuables that would be easy to carry. He found Sally's jewelry box that was filled with valuable jewelry, tucked it under his arm, and left through the back door. As Mark was driving his car away from the scene of the crime, a police officer pulled the car over for having only one working headlight. Spotting the jewelry box sitting on the front passenger seat, Mark was arrested and charged with burglary. Is Mark likely to be found guilty of burglary
