Dan is camping in the woods with some friends. They wake up early the next morning to go on a hike to see the sunrise on a mountain peak. They have food out from breakfast and don't want to take the time to put it away because they are running late. Dan decides to just take all of the food and put it in Paul's tent, without sealing it up in anyway. He tells everyone he will seal it up when they get back.

Dan does not realize that Paul is still in the tent sleeping in his sleeping bag. Dan thinks Paul is with them on the hike.

A bear smells the food, bursts into Paul's tent, and badly mauls Paul while eating the food.

My answer:

The standard of care is the amount of care required to act reasonably. It requires the amount of care that a reasonably prudent person would use in the same or similar circumstances.

To breach a duty of care is when a person fails to meet the standard of care as a reasonable person would. Dan failed to meet the standard of care and the harm caused by the breach is foreseeable. Dan failed to use standard care as a reasonable hiker would use when he decided to place uncovered food items in Paul's tent and not away from the campsite.Dan knows the standard practice for hikers is to store food in airtight containers and away from the campsite. Dan's duty was to seal the food and keep it away from the campsite, he failed to adhere to the standard practice as a reasonable person would do which caused a bear to go into Pauls' tent because of the food smell and critically savage Paul while devouring the food.

Dan did breach a duty of care to Paul.
