Corporations are obviously not biological entities. However, the law finds it necessary to provide corporations with certain rights and responsibilities commonly held by people. The criminal laws of our Country are designed to incarcerate humans that break the law. The same is not true for corporations that are treated like humans in many instances.

Should corporations have the same protections under the U.S. Constitution as humans even though the corporation cannot be punished or deterred in most instances like a human? Why or why not?

Should corporate officers be able to be punished in place of the "legal person", the corporation, so that there is equity under the Constitution? Why or why not?

If we punish corporate officers or corporations and force penalties on a corporation for illegal behavior will the law be fair to shareholders? Should shareholders be accountable for the behavior of the corporate officers?
