MOLLY AND LAURA

Molly and Laura have been friends since childhood. They attended the same grade school and high school, and now they are studying graphic design at Humber College. They see each other several times per week and speak almost daily. They are both excited as their friend Sukhi is getting married on May 25, 2022 and they have both been asked to be bridesmaids.

On January 22, 2021, Molly and Laura were travelling westbound on Highway 401. They passed highway 427 at approximately 6:30pm. They were going to a bridal store in order to try on their dresses for Sukhi's wedding.

Molly was driving. She had not been drinking that day at all. She was travelling at approximately 100km/hr. Normally, she would drive somewhat faster but there was a bit of freezing rain so she decided to slow down.

Molly and Laura were discussing the wedding and Laura was showing Molly some earring she found online. Periodically, Molly would glance at Laura's phone but never touched the telephone herself.

All of a sudden, Molly slammed on the brakes. The car in front of her had slowed down dramatically which Molly was not expecting. In part, due to the road conditions, she was unable to stop and hit the vehicle in front of her. No one was injured but Molly was charged with careless driving.

  1. Identify 5 legally irrelevant facts

3. Identify 3 issues (remember, when it comes to issue identification, we are talking about legal issues, NOT factual issues)

  1. SAPNA AND SAM

Sapna and Sam are having a pool party for their daughter Sally. It is Sally's 13th birthday party and approximately 30 of her friends are invited. Sapna and Sam intend to supervise the party and make sure everyone is safe.

Brenda and Ben are the parents of 14-year-old Bethany. Brenda has always wanted to be a model but her dream did not come true. After years of trying to break into the modeling business, she finally gave up and became a nurse. However, modeling had remained an unfulfilled dream of hers.

Brenda was delighted when Bethany started modeling as a toddler. Bethany was a cute child and did well in front of the camera. Over the years, Bethany's modeling career continued to develop under the guidance on her mother.

Bethany attended Sally's birthday party. Bethany's parents know Sally's parents and were assured that the party would be supervised. Sally's parents knew that Bethany is a strong swimmer as she and Sally would often spend time by the pool in their presence.

Bethany dove into the pool and it appeared that she had misjudged the depth of the water. She dove into the shallow end of the pool and hit her head. Her forehead was bleeding profusely and she required 14 stiches. She also suffered a concussion.

Bethany's parents have come to see you. They want to sue Sally's parents for the pain and suffering Bethany endured, as well as for loss of future income from modeling, as Bethany now has a large scar on her forehead. Brenda fears the scar will make it more difficult for Bethany to book modeling work.
