Coleman My son Douglas Robertson after spending 6 years in prision for a crime he did not comitt. I. am his mother who has learned the prosecutors had failed to turn over evidence that would have cleared his nane. Failure to disclose exculpatory evidence a proseutor has a legal duty to give the defense the following evidence: evidence suggesting that the accused is not guikty, and evidence that the accused deserves a lesser sentence. This evidence is often referred to as "Brady material."The label comes from a real legal case Brady V. Maryland. Doug is charged with sexual abuse charges after a grand jury indictment. He has vehemently denied the charges since the first day he was investigated for it. There is no DNA evidence and the victim Emily made no disclosing re: any sexual contact with Dougie. When asked about a bider from the security camaras at the wellness center pool in Hartford ky she still denied any contact (physical) with Dougie. She did say that he did throw up in the air at the pool. This document was not produced in the motion of discovery and my son had no knowledge of this document. Timothy R. Coleman has a rule that the prosecution has a constitutional duty of due process to disclose material evidence favorable to the defendant. This document discovered since the conviction and not discoverable by reasonable dilligence beforehand.

In practice,if the prosecutor suppresses or fails to disclose evidence that is material to the defendants guilt verdict or sentence, or influences the credibility of a witness no matter whether the prosecutionis of good or bad faith, intentionally or inadvertently, the defendant can use the brady material to get a new trial. I am enclosing the document as Exhibit A. that the prosecutor failed to give to my son.
