Before you get too deep into your paper, be sure that you review the instructions regarding the Term Paper on the Syllabus Addendum. Also, you will find a link to my Grading Template in both the Early Submission and Final Submission folder in Assignments & Exams. Whichever topic you choose to write about, I suggest that you make liberal use of examples to illustrate the points you are trying to make. I have tried to select ideas for topics from the earlier chats, so that you can take advantage of your preparation and our discussion as you develop your paper. Do remember, your Term Paper should be no less than 5 pages and no more than 8 pages in length (the text of the paper, that is--not counting coversheet, abstract, reference list, etc.). You may suggest other topics, but be sure to get my OK if you are going off list. The list below includes both computational areas and descriptive areas. My suggestions for paper topics are as follow: Portability of AEA--Why, How, When not to, Examples, etc. Probate Process & Alternatives to Probate. This is a less quantitative, more descriptive topic. What is the purpose of probate? How and why might one wish to avoid probate? What are the three main alternatives to probate and what are the advantages and disadvantages of each? Estate Planning for Life Insurance. Certainly any discussion of life insurance would start with the role it can play in estate planning and when it is or is not included in a decedent's gross estate. Life insurance trusts (ILITs, irrevocable life insurance trusts) would also be a major part of the paper, including issues relating to funding of the ILIT.. QTIP Trusts/the QTIP Election and Qualified Disclaimers. Both of these provisions can offer the estate planner an opportunity to engage in "fine tuning" of an estate plan, after the person for whom the plan was implemented has died-postmortem estate planning. Explain the role QTIP trusts and qualified disclaimers can play, including a clear explanation of the requirements and consequences of each. Alphabet Soup of Estate Planning--AB Trust Plan, Asuper-B Trust Plan, ABC Trust Plan, AdB Trust Plan, ABdC Trust Plan. Present and explain each plan and describe the what additional power or flexibility each plan brings to the table. This topic will require very careful organizational consideration. I don't want you to give me a bunch of bullet-point lists. You will probably want to organize your paper as a series of comparisons--e.g., AB vs. ABC; AB vs. AdB, ABC vs. ABdC. And, of course, you will want to circle around and explain why each is better than a 100% Marital Deduction Plan--i.e., leave everything to your spouse. In some cases, the 100% MD Plan may make sense, too. Gift & Estate Impact of Lapsing General Powers of Appointment. Use of GRITs, GRATs, and GRUTs in Estate Planning. Property Titled Joint with Right of Survivorship--Amount included in gross estate. Consideration furnished rule compared with Spouse rule. Opportunities presented by consideration furnished rule.
