QUESTION 1 (15 marks) Greg took his family to the beach for a picnic. The road went along the beach frontage, passed a concrete boat ramp, and then Greg found a space in a car park facing the ocean. Between the cars and the beach was a grassed area and a rock wall. There were picnic tables in this grassed area. It had been raining earlier in the day, but it was sunny whilst he ate his afternoon tea. After eating. Greg decided to walk down to the beach. He walked along the grass immediately in front of the parked cars towards the boat ramp which gave access to the beach. He was able to pass between a shrub and behind a large sign and join the boat ramp with just a small step/jump down. As Greg walked down the ramp, he slipped and fell, hitting his head on the concrete ground. The ramp was wet, probably from the rain. He has suffered serious personal injuries. The large sign had WARNING, in red and at the top, and to the right of this the following words: "This beach may be dangerous. Look out for hazards to yourself and people in your care." Below were a number of triangular pictograms with words showing things like 'boat ramp', 'sharks', 'strong currents', 'submerged rocks', 'slippery areas', and 'marine creatures'. Further below were crossed circles to indicate no glass, no camping, no dogs, and no fires. This sign is clearly visible from the road and is on both sides of the start of the boat ramp. The Wise Beach Group had the care, control and management of the boat ramp and had erected the sign. Greg was a fisherman and a boat owner. He would fish from rocks, the beach and his boat from time to time. Whilst he had visited this beach previously, he had not used the boat ramp before. The boat ramp was submerged from time to time by seawater, so it was subjected to the growth of marine life on its surface. The Wise Beach Group organised to have it pressure cleaned once a month. It was known that frail or less agile people would use the boat ramp to access the beach, as they would not be comfortable climbing down the rock wall. Greg says The Wise Beach Group were negligent in that they should have given a separate sign specifically drawing attention to the fact that the boat ramp was slippery. Fully explain Greg's claim in negligence only, and discuss the defence(s) The Wise Beach Group might raise in response to this claim
