I want to do some planning for my family and would like to transfer some share ownership of FBL and BBI to each of my son, Charlie, and my husband, Elliott. Charlie, who is currently 21, will work for FBL once he graduates, and Elliott is already working for FBL and being paid a reasonable wage. I would like them to share in the growth of the companies so that they would have some gains taxed in their hands whenever I eventually sell FBL. I was thinking I could sell them each a quarter of my existing shares for $25, but I can't believe it would be that simple. What would be the tax implications for me if I did that? Would it result in a capital gain? Who would pay the tax on any future income or capital gains earned on these shares? Are there any tax on split income (TOSI) matters I should consider? As you can see, I would like to minimize adverse tax consequences so do you have any other suggestions as to how I could get them to be shareholders in my companies
