I would like to help me how to answer this case study using IRAC method. You work as a graduate for Prosecution Services, Office of Industrial Relations, Queensland Treasury. Assume on the day the assignment was released your supervisor gave you the facts contained in Part A below and asked you to draft a memorandum on the potential breaches of WHS Laws in Queensland. In your memorandum please set out the issues, law, application and conclude. Please presume that laws specific to the COVID-19 pandemic are being complied with. Focus on the WHS Act and related regulations, codes and cases. At Home Play Pty Ltd (Play) has a vision that they will "find ways to fill your day at home with physical activity that is fun". They sell some of their own products that they design and manufacture as well as ones they purchase from other businesses in Australia and abroad. They operate in Brisbane with about 50 staff over a number of factories and warehouses. The COVID-19 pandemic has tripled business and they now have 150 staff working for them and they have rented new facilities. Out of the 150 staff, 120 are employees of Play, and 10 are employed by a labour hire company Ready to Work, 10 are volunteer work experience students from the local training college and 10 are employed by Tan Work (Tan). Play has contracted with Bell Pty Ltd (Bell). Bell contracted to provide workers to Play. Bell then sub-contracted with Tan who actually provided 10 of Tan's employees to work in Play. Since the beginning of the Pandemic, Play has become exceptionally busy. Play has held socially distance OHS meetings each week as part of their weekly meeting. On 21 July 2020 Pat, the Manager at Play, said that workers would need to do "live work maintenance to keep up with productivity". The OHS representative Pam asked worriedly "do you mean when equipment is live and moving parts?" Pat smiled and said "yes". Pam, who had worked with Pat for 5 years said "What's the catch?" Pat laughed and said "if workers get into moving parts they will lose limbs and die. So no one ever gets into a moving part! That is, no human!" Pat then showed everyone the new specialised tool for safely doing live work. Pat showed workers a remote-control high-resolution camera on an anti-vibrating base that swivels 360 degrees. Its 30-Chrises optical zoom allows workers to read gauges, look for leaks and carry out pre-maintenance checks. Pat nicknamed it "Robo- Checker". Pat explained that Robo-Checker can be used to read gages, dials, check oil and other maintenance issues while equipment is live. If something is wrong, Pat explained "the equipment can be stopped, tagged and then inspected by a human. Over the week of 27 July 2020 Pat gave everyone access to on-line videos of using Robo-Checker and gave leading hands additional training. Pat explained that leading hands would help coach other staff as they were given the chance to use Robo- Checker. Pat pointed out that if Robo-Checker was not used properly then it was designed to not interfere with moving parts and there were sufficient staff around to give a hand. The incident in question occurred on a machine where Robo-Checker was in operation. On 6 August 2020 the leading hand on the cutting machine was sick and the most senior worker in the team, Pablo, was in charge. Pablo was leading Ronda from Ready to Work, Chris from the local training college and Tammy from Tan. All four of these workers have had a basic OHS introduction but have not been trained on maintenance. Pablo has some training on the Robo-Checker but had not used it much. Ronda was more experienced and used it every 15 minutes to check things were operating as per policy. About 1pm on 6 August 2020 Ronda noticed Robo-Checker was not working. She mentioned this in front of Chris and Tammy and walked around the corner to tell Pablo. Tammy looked in the machine and saw through moving parts that the lense of the camera had grime on it. She got her golf umbrella and taped a small sponge on the end. She then hit pause on the machine and put her makeshift cleaning device into the machine and cleaned the lense. She had just finished when Pablo walked around the side of the machine and shouted "STOP! WHAT ARE YOU DOING!" Chris, startled, hit go on the machine. The machine started to move and Tammy's umbrella was smashed and she cut her arm on the splintering umbrella. It was a minor abrasion, which bled a little but did not need stitching and would not scar. Pablo told Pat about the incident, who in turn called Tan to attend a meeting with Tammy, Pablo and Pat on 7 August 2020. In the meeting on 7 August 2020 Tammy said she had not been trained on maintenance but the policy on the intranet she had downloaded to her smart phone said that moving machines should be stopped or paused and tagged. The definition of tagged in the policy seemed to show that it had not be clear to everyone around. Tammy argued, since Chris was the only person around, and since she told Chris to make sure no one hit the button, she had effectively tagged it. The Tan manager, Tod, spoke on behalf of Tan and showed Pat, Pablo and Pam the file where Bell had informed Tan that Tammy had all training and this list included maintenance. Pat said Tan should have checked with him. Tammy thought the training she had been given was maintenance. It turns out it was not but she was mistaken
