Todd is going to need some help in moving the fence in the back yard. He contracts with Johns "Post and Putter" supply company to rent a fence post digger. John assures Todd that the machine will remove a 16 inch wooden fence post without any damage to the yard, inground pool, or other landscaping. Todd gets to work. Unfortunately, the machine that is delivered is a tool used for sword fencing and not landscaping. Based on John's promise, Todd is sure this machine will pull out the stubborn timber. Not only does the tool pull out the fence post, but also the water line Todd had installed for the pool. Todd now refuses to pay John the cost of the machine and John sues for breach of contract. In addition, now that Todd is unable to complete the house renovations under Julie's strict time table, Julie sues Todd for breach of contract.
