If an accused confesses of a crime in front of you, you would tell to the attorney in a deposition that the accused confessed in front you. The ethical guideline only holds up till the time you don't have any knowledge of the accused committing the crime, once he has confessed to you, you are not expressing an opinion but rather stating a fact.
