If I promise to deliver 10 tons of rock to a builder on Sept 1, 2020 and "time is of the essence" as written in the contract. Can I text and tell the builder I will be three days late or am I liable for his losses, since the builder had to buy the stones from another vendor in order to comply with his construction obligations
