Maxwell Loaded v Pastor Gijima Pastor Gijima runs a charismatic ministry in Durban with a substantial congregation of followers. During one of his lengthy Sunday sermons, Pastor Gijima tells the members of his congregation that he has had a revelation:- and tearfully he blurted out the world was coming to an end soon! With a thundering voice he commanded the congregation to repent and to loosen the shackles which bind them to earthly goods. "Money", he said, "is the root of all evil, money is an obstacle to your salvation"! Whilst saying this, Pastor Gijima looked directly at Maxwell Loaded, a wealthy businessman who has made substantial donations to the church of Pastor Gijima in the past. In one swift movement Pastor Gijima leapt off the stage where he was conducting the sermon and walked straight to Maxwell Loaded, shouting "repent" several times. Maxwell was griped in fear, having visions of himself burning for etemity in the underworld. He fell to his knees and starting weeping, imploring Pastor Gijima to help him save his soul. Pastor Gijima said he will pray for a divine message for Maxwell Loaded. That evening, Pastor Gijima phones Maxwell Loaded and told him that he had spent the entire afternoon on his knees, praying for Maxwell's soul. As the sun set, Pastor Gijima said, he heard a voice that told him to tell Maxwell that he must get rid of his earthly goods urgently for time is running out. Pastor Gijima suggested to Maxwell that he should donate his wealth to the church and his soul will be saved. Maxwell immediately agreed, happy to hear that he will now go to paradise when the world comes to an end. Ten minutes later, Maxwell receives an email from Pastor Gijima with a contract attached for the transfer of all Maxwell's earthly goods to the church. Maxwell signs the agreement. On Monday morning, Maxwell tells his sister about what happened, happy to share in his joy of salvation with his family. Maxwell's sister is furious and tells Maxwell to phone Pastor Gijima immediately and tell him the agreement is off. Maxwell realises he has made a big mistake and phones Pastor Gijima, telling him that the agreement is off. Pastor Gijima refuses and tells Maxwell: "too bad, you have signed". Maxwell approaches your court on an urgent basis asking for the agreement to be declared void because 'he was not thinking straight' when he agreed to Pastor Gijima's suggestion. You be the judge! Give a verdict and reasons of your decision
