Imagine this

Ms. W.P. and Mr. W.P. live with their two children, who are seven and two, in a major Canadian city. They love their children and are loved by them. They care for their children and provide them with support and all the essentials. Both parents are white supremacists who believe strongly in the superiority of the white race. They have posters of Adolph Hitler in their house and both have tattoos of a swastika on their arms. The parents donotexplicitly advocate violence; but they both believe that people from different races should not mix together. They oppose multiculturalism and believe strongly that the white race is at risk from the increasing presence of people of colour in Canada. They are raising their children to have the same beliefs.

Their 7 year old daughter drew a swastika on her arm and went to school. Her teacher was alarmed to see the swastika and even more alarmed when she found out her mother helped her draw it. A representative from Child and Family Services visited the home and concluded that the home environment was worrisome and that "the parents' conduct and associations might harm the emotional well-being of the children and put them at risk". And so they decided to remove the children from the home.

Analyze these facts taking into consideration all relevant sections of the Canadian Charter of Rights and Freedoms. What kind of arguments would you make in support of the position of the parents? What kind of arguments would you make in support of the actions of the Child and Family Services Agency?Which of the two sides has a stronger claim, in your opinion, and why?
