All I want is a clear, concise story of how you dealt with your accused from the very first moment you saw his/her car to the final moment you either released him/her from custody.
  • WHY am I having you do this? YOU can minimize losses in court by writing a DETAILED account of their appearance, language, etc., which will refute their later claims that they were sober and acting normally. Naturally, a video camera comes in handy here too, but you don't always have one at your finger tips do you?

"steps " to an Impaired Investigation:

1.Observations of the car (weaving? Etc.)

2.Pull the car over (jerks to a stop? Etc.)

3.Initial observations of the driver

4.Ask driver to get out of the car. More observations. Some roadside tests (finger to nose, etc.).

5.Arrest, caution, "breathalizer" demand (you are going to skip the ASD because this person is obviously drunk to you.) Or, you aren't sure so you make the ASD demand and, depending on the results (pass, warn or fail) treat the person accordingly.

6.Back to step 5, in the first instance where you are going to skip the ASD, take them back to the station, hand them over to a breath technician (you can't test your own accused). Get the readings and charge Impaired, Over 80 mgs. or,Impaired/Refuse breath sample. Serve all the documents on the accused and release them (if sober enough...if not put in a cell for a few hours).
