In 1927 Carr Steamship Company delivered to Western Union a twenty-nine word coded message to be sent to Carr's agent in Manila. The message included instructions for loading cargo onto one of Carr's vessels. Carr's profits on the carriage of the cargo were to be about $6,600. Western Union mislaid the coded message and it was never sent. Carr sued Western Union for the $6,600 in profits that it lost because Western Union never sent the message. Can Carr Recover?
