In 2020, 17-year old Hannah was homebound and studied matric online, due to COVID-19. Bored and surfing online Hannah happens upon an advertisement from Grace, setting beautifully wrapped fragrant soaps advertised as pure luxury indulgence during lockdown. Hannah contacts Grace who offers to teach and excited Hannah how to make the soap on condition that Hannah buys all the manufacturing products from Grace. Hannah Duly signs the contract to that effect and pays Grace for the first batch of the manufacturing products. When Hannah's mom starts to ask questions, Hannah leaves her mother under the false impression that she is only helping out a friend with a hobby to take their minds off the pandemic. Hannah continues manufacturing and selling ordering and pain from her savings accounts for two more batches of manufacturing products from Grace. When Hannah orders yet another batch from Grace she promises to pay Grace at a later date saying that she is still trying to expand her customer base.

Hannah soon realises that she can buy products from a discount store, XYZ sales, allowing her to sell her soap at a reduced price. When Grace inquires about payment and the placement of further orders Hannah lies to Grace saying that she is focusing on her matric studies for now and that she will resume her business later, which is when she will pay Grace.

On 31 March 2021 Hannah places an online notice for an Easter special on her stops which coincides with her 18th birthday. In the notice Hannah thanks grace and XYZ Sales For their roles in the success of her business. She also thanks her large number of loyal customers for their support. Grace happens to read the notice and promptly sends Hannah an email reminding her of the contract and the outstanding payment for the purchase off the last batch of products. Hannah does not respond. On 17 April 2021 Grace goes to Hannah's house where Hannah tells her that she is too busy to speak to her as she is dealing with the orders that are streaming in since the Easter special. An incensed Grace accuses Hannah of breaching the contract, as Hannah discontinued buying manufacturing products from Grace, which Hannah was required to do in terms of their contract. Grace sues Hannah for the outstanding payment for the last batch of manufacturing products that she ordered and received.

Hannah is upset and approaches you for legal advice on whether she is contractually bound to pay Grace for the outstanding payment. Refer to the relevant sources of the law, including case law.
