1) What are the limitations of a color design patent? How would you go about explaining that the purple color of the iPhone is ornamental and improves the appearance of the iPhone and not its actual function?

Well, the limitation of the color design patent is it only protects the color and not the design itself. Another limitation of the color design patent is that it only lasts for 15 years then someone else can us it. Well, I would state that the function of the phone is to make and receive calls and text and run applications. The color purple just simply just improves the appearance of the phone and doesn't have anything to do with the function of the product.

2.) Now pretend your color design patent is denied because the patent office finds the matte coating of the purple on the iPhone is functional and not ornamental in that it prevents the phone from slipping from the grip of someone holding the phone. How would you make the argument that the matte coating on the purple phone is purely ornamental? Provide your argument below:

I would try to make the argument that there are a lot of different and even better material to keep the phone from dropping out your hand and I that was our goal we would put the best material if that was sole purpose of the mate color way. Hopefully that argument will debunk their decision and get t it overturned.

3.) Pretend you make the above argument, but the patent office once again denies your color design patent. Apple is getting impatient because they are ready to send the purple iPhone design to production to start making profits. How would you instruct apple concerning the color design so that you could still push things through with the patent office to permit Apple's purple iPhone to be put on the market?

I would just instruct apple to modify the design and suggest instead of using matte purple change to something like a gloss purple or something along those line to just remove the controversial of the matte.
