In a case brought forth by the board of nursing for formal charges in the State Office of Administrative hearings, define a "scheduled hearing on the merits" as stated in 1 TAC Rule 155.505(b)(1) "A party may file a motion for summary disposition at any time after SOAH acquires jurisdiction over a case, but the motion must be filed at least 30 days before a scheduled hearing on the merits."
