In a civil case, a Defendant may decide to exercise his or her Fifth Amendment right to refuse to answer question(s), if there is a risk that those answers would implicate that Defendant in criminal wrongdoing. If the Defendant exercises his or her right and refuses to answer those questions, then the Court in the civil case may instruct the jury that it may draw an "adverse inference" regarding the questions that were not answered.
