In an unsecured loan agreement, in the event that there are no constraints or the agreement is silent on the matter of assignment, is the borrower free assign or delegate their rights and responsibilities to a guarantor who nominates herself? Would a new independent document (ie a deed of guarantee of a loan) need to be signed by the guarantor in order for the guarantor to indicate that they are willing to take on those rights and obligations?
