In April 2021, Chris lost his job as a restaurant manager and due to rising costs of living, he was unable to maintain payments on his mortgage. In August 2021, Chris was issued with a repossession notice by Lloyds Bank to vacate his home by 20th December. Worried about becoming homeless with his family, Chris decided to move into a mobile home in his home town in Suffolk. On 12 December, Chris saw an advert in a local newspaper by Boyd for “a mobile home, fully insulated, in good condition, ready to move-in” for £20,000.

Chris called Boyd to view the mobile home during which, he discovered that the window by the rear was loose and the frame severely damaged. On his way back, Chris asked Boyd whether he would accept £15000 and also, replace the window before the purchase is completed. Boyd immediately replied that “I will accept £18000 and will replace the window too.” Chris paid £10,000 deposit with the balance to be paid on collection of the mobile home after fixing the window.

The following morning, Boyd contracted with Mobile Homes Ltd to fix the window for £1000. They both agreed for the work to be completed by 18 December. However, Mobile Homes Ltd soon discovered that the cost of window replacement would be £2000 due to its unique design, as the mobile home was a 1920s model. Boyd informs Chris about the change in price of the window. Worried that he might spend X-mas with his family homeless, Chris reluctantly agreed to an extra payment of £1000 provided the work is done by 18 December.

Once the work is completed on time, on 18 December, Chris is not satisfied with the quality of the new window as he thinks it is quite different from the other window and refuses to complete the purchase of the mobile home and requests his deposit back from Boyd. He also refuses to pay the extra £1000 and insists that he will only pay the originally agreed price. Boyd has also refused to pay Mobile Homes Ltd £2000 for the window replacement claiming that it is Chris who should pay for the window.

(a) Advise Chris and Boyd whether they had a valid contract and whether, either of them is in breach of contract.
(b) Advise Boyd on whether Chris should be compelled to complete the purchase of the mobile home and the extra £1000 for the window replacement.
(c) Advise Mobile Homes Ltd on who is responsible for its contract for the window replacement.
