In Chapter 2 of the course text, the author discusses the three locations in the Criminal Code of Canada (hereinafter, "CCC") that need to be consulted to determine whether an offence is an indictable, hybrid, or summary conviction offence and the penalty applicable to the offence:

1. Where the penalty is set out in the offence section (i.e., in the description of the offence) itself.

2. Where the penalty is set out in the section(s) following the offence section.

3. Where the offenceonlymakes reference to the fact that the offence is punishable on summary conviction and do not mention a specific penalty. In which case reference will need to be made to s. 787(1) of the CCC.

Each is to find ONE offence (NOT DISCUSSED in Chapter 2 of the course text) to illustrate each one of the above categories. This means that you will need to discuss and describe THREE different criminal offences from the CCC.Even if one of your selected offences may be used to illustrate more than one category of offence, you still need to find and discuss three criminal offences. In your discussion of each offence, you will need to do the following:

A. Please set out the text of the offence provision and all other relevant section(s) of the CCC (verbatim) for each of your chosen offences before engaging in any discussion of the provisions. Please include the relevant section and subsection number for each offence. If you are making reference to multiple sections of the CCC for a single offence, please excerpt the sections of the CCC in sequential order. For example, s. 265 describes the offence of assault; while s. 266 provides the penalty provisions for this offence. Hence, the text of s. 265 would have to be set out before the text of s. 266.

B. Please ITALICIZE the text of all sections of the CCC to avoid confusion with the text of your discussion of the offences.

C. Please explain the classification of each offence (as indictable, hybrid, or summary) with direct reference to the text of the relevant CCC provisions.

D. Please explain the penalty provision of each offence with direct reference to the text of the relevant CCC provisions.

E. Please explain a paralegal's ability to represent the accused on each one of your chosen offences, with reference to s. 787(1).
