in essence, a story- about a person who has a negligence case for premises liability. Keep in mind that this person (Plaintiff) will come to our law firm for their case, and you will role-play this Plaintiff. Another student will role-play the paralegal doing the interview and ultimately drafting a complaint based on your Fact Pattern. The plaintiff and Defendant are made-up characters

The plaintiff must be a business invitee who is injured on the premises of some type of business through the owner's (Defendant) negligence. The defendant must be the owner of the property, not a tenant. The case must take place in Delaware as the Plaintiff's complaint will eventually be filed in the Delaware Superior Court. Make sure your Fact Pattern includes information about each of the five elements of negligence: duty, breach of duty, actual cause, proximate cause, and damages.

You must write a fact pattern about the situation in which Plaintiff was hurt due to Defendant's (business owner) negligence. When you write your fact pattern be very thorough in describing not only the injury, but information about Plaintiff and Defendant

Including the following fact pattern information:

One plaintiff

One Defendant

Plaintiff's address

Defendant's address

Plaintiff background information like their age, marital status, place of work, plaintiff hobbies, etc

Defendant background information like their age, marital status, place of work, plaintiff hobbies, etc

Date of injury

Place of injury

cause of injury (describe the injury they suffer)

proof of harm

two eyewitnesses (name, age, address, who were they, how they came there and what were they doing)

Include three pieces of evidence

photograph (Describe the photograph)

Describe the types of business

3 treatment providers, like a family doctor, surgeon, physical therapist, or hospital (Include names and addresses)

Describe what the plaintiff was doing and wearing
