In May 2016 the Government of Grenada (GOG) passed the Electricity Supplies Act and the Public Utilities Regulatory Commission Act. The Acts came into force on August 1st 2016. According to the GOG the legislation was passed to restructure the electricity sector to the benefit of the country as a whole. Given the existing Share Purchase Agreement of 1994 the Acts had legal implications for the relationship between the GOG on the one hand and the Grenada Private Power Ltd (GPP) and WRB Enterprises on the other hand. Discuss the claim that GPP and WRB were entitled to compensation given the passage of the 2016 Acts and access the reasonableness of the quantum of the award of the ICSID arbitration tribunal.
