In September 2010, Harry granted to Lucy a lease of a shop for a term of 20 years at an annual rent of 12,000, payable at the rate of 1,000 on the 1st day of each calendar month. The lease provided that Harry's consent was required for any assignment of the lease, and that Harry was entitled, as a condition of giving consent, to require the assigning tenant to sign an authorised guarantee agreement.
During May 2018, Lucy assigned the lease, with Harry's consent, to Kelly. Kelly assigned the lease to Alan in December 2020, also with Harry's consent. However, Alan has failed to pay any rent since January 2021 and has now vacated the property and is unable to be located. Harry assigned the freehold reversion to Neil in March 2021.
