In the case Williams V Roffery the court decided that a promise to perform a pre- exsiting contractual obligation will amount to good consdieration in the exception of the 'practial benefit' principle. However, this principle has itself caused diffculites and been heavily crticsed by both courts and commentator. Why could this be the reason? Why would intention to create legal relations be a better approach when dealing with such cases?
