In the following sentence, I feel like it is a bit passive "was not treated" and I'm not sure if I wrote the sentence with a mixed conditional ("show" as present tense and "was" as past). How could I re-write the sentence better? (I'm writing a legal letter for a client)

Sentence: "These factors show inequities in division if the dog was not treated as divisible."
