In the Ibanez case, the Court noted that Massachusetts does not require a mortgage holder to obtain judicial authorization to foreclose on a mortgaged property. Tennessee has the same rule, it does not require judicial authorization to foreclose. Explain whether you are in favor of maintaining this rule, or modifying it.
