He is being sued in Small Claims Court for $20,000 and has provided you with a copy of the Statement of Claim. You have 15 days remaining to le a defence. You have agreed to take Mr. Jones on as a client and have opened a client le for him. You are now ready to continue on his matter. After reviewing the general information given by Mr. Jones, you realize that you are missing information and that you need to ask more effective questions to obtain further details and determine what other relevant information is necessary to le a defence. 1. To help you to develop your theory of the case, prepare a set of questions you need to ask your client that are relevant and material to the case in order to prepare the defence. 0 List 15 questions, steps, or a combination of the two to receive full marks. (15 marks) 0 Only the rst 15 items will be marked. You will not increase your mark by providing more than 15. 2. Based on the scenario, develop a theory of the case using the ve steps outlined. (5 marks) After your initial interview with Mr. Jones, you have the following information: Mr. Ken Jones is the owner of 123 Main Street West, Hamilton. He has a snow removal contract with Mr. McLeod. The contract is in writing to remove snow within 24 hrs. After a heavy snowfall, no snow removal took place on the front sidewalk of Mr. Jones' home. The sidewalk is owned by City of Hamilton. Mrs. Smith an 82 year old neighbour went out to walk her dog the day after the snow storm. During her walk she slips on the snow and ice and falls in ont of Mr. Jones' house, breaking her left arm. Both the City of Hamilton and Mr. Jones are served with a Statement of Claim
