In this particular situation it would be employers' word against my word, so it may cause lots of tension throughout the workplace, but I still believe I have a chance at winning. Colossal Department Store promised me 3 weeks of vacation and now they are going back on their word and even though this agreement was not in writing it would still be considered an oral agreement. Making this an express contract, due to the fact that the company offered me the job including all of the benefits listed above and accepted. The company must fulfill what they promised in the oral agreement and if they do not it would be considered misrepresentation, which can lead the company to a bad reputation and no trust from their employees. Although when this case goes to court it would be much easier to win if this agreement was in writing and due to the fact that it is not, the company may still have a chance of winning. If other employees stepped forward with the same complaints that there promises to have not been met, then my chances of winning would be better.
