Background: I require an essay because being able in the Criminal Justice Field. A police officer can make the best case in the field by gathering evidence, finding witnesses and locating a suspect, but if that officer cannot write an accurate and comprehensive police report, that case may not get filed by the DA and the suspect may be set free. The only thing the prosecution, defense and courts know about the case is what you wrote. That is why it is so important. Most police candidates who do not get hired, or ones that get hired and do not make it through probation is because they cannot write good police reports. You may say that you are not interested in being a police officer and that is ok, but this is equally as important for probation officers, sheriffs, CHP, Attorneys, legal aids, judges, counselors, etc.... the list goes on. It's also essential to professions outside of the criminal justice system.
Essay Instructions
Police Officers have to understand what constitutes a Lawful Temporary Detention, and at what point that Detention becomes an arrest based on Probable Cause. In other words, the Officer needs to know the difference between the two.
So, with that being said, write an essay so I know you have an understanding of the two. I am only interested that you have a basic understanding between a detention versus an arrest. In this essay:
Explain "Articulable Suspicion "as it applies to a "Temporary Detention" by a police officer.
Explain what "Probable Cause" is to make an arrest.
Use an example your own, of a police detention based on articulable suspicion. Using that same example, add elements to that contact to establish probable cause for an arrest. (Do not use the same examples that I may have used in this week's lecture, use your own examples).
