Instructions: This is the discussion board forum for this learning module. You must (1) submit an initial post, and (2) reply to at least TWO classmate posts. Your INITIAL POST deadline is Thursday, 11:59PM. Initial Posts submitted between that deadline and the deadline for the Peer Replies are subject to a 25% reduction of points earned. Your PEER REPLIES (TWO or more) are due Saturday, 11:59PM. You must submit your initial post before you can review your classmate posts. For your initial post, make sure to read the scenario and discussion board questions (Topic Questions AND Reflection Questions) before you submit it. Your initial post should be in paragraph form, use correct spelling, punctuation and grammar, and be at least 500 words. Do not copy and paste the discussion questions in your initial post.
Posts should incorporate information from the learning materials. Make sure to properly cite all sources. Avoid long quotations; speak in your own words. To further illustrate your point(s), use examples, e.g. a case, a hypothetical situation, or--better yet, if you are comfortable disclosing information--an experience of you or someone you know (family, friends, co-workers, etc.).

Assessment: This is a graded assignment worth 55 points, of which the Initial Post is worth 35 points, and the Peer Replies are worth 20 points. A grading rubric may be used.
Discussion Scenario: Emma Jones hired Sandy Porquine, an attorney, to draft her will. The will named Bob Kripto and others (Kripto) as beneficiaries. When Jones died, it was discovered that the will was improperly drafted, violated state law, and was therefore ineffective. Jones's estate was transferred pursuant to the state's intestate laws rather than pursuant to Jones's will. As a result, Kripto did not receive the $75,000 he would have otherwise received had the will been valid.
Discussion Questions: After reviewing the learning materials in this Module, prepare an Initial Post that incorporates these materials to answer the following questions. Also, your grade in this learning activity relies on your engagement in the discussion through your Peer Replies (TWO or more).
Topic Questions:
- If Kripto sues Attorney Porquine for breach of the Jones-Porquine contract to recover what he would have received under the will, could Attorney Porquine successfully defend himself due to Kripto not having standing to sue? Why or why not?
- If his breach of contract case goes forward, would Kripto win? Why or why not?
- What sort of remedy(ies) are possible to Kripto if he wins?
