Instructions: Your assignment is to draft four (4) letters as described below. Your letters must be typed and adhere to the requirements below. Remember to use spellcheck and proofread.

Letter #1: Scheduling a deposition

You are a paralegal for a law firm called Jones & Associates, LP. The offices are located at 123 Main Street, Lawrence, MA 01840. Your supervising attorney is Robert Jones. Recently, Robert has brought you in on the case of Connors v. City of Lawrence, in which Elizabeth Connors is suing the City after she tripped and fell on cracked pavement. Your firm represents the defendant, the City of Lawrence. Robert tells you that he spoke with opposing counsel, Mary Smith, at the law firm of Smith, Days & Roe, LLP, and that he and Mary scheduled the deposition of her client, Elizabeth Connors, for Friday, March 10, 2023. The deposition will be over Zoom and start at 10 a.m. You will send the zoom link ahead of the meeting. Robert asks you to draft a letter to Mary confirming this deposition. He also asks to you cc him and another attorney in your office, Sally Walker. This letter will go out by regular mail only. There are no enclosures with this letter.

Letter # 2: Transmittal Letter

You are a paralegal working for the law firm of Dillon & Associates. Your supervising attorney, Stephanie Dillon, asks you to draft a letter to the firm's client, Suzanne Nichols, to send Suzanne a copy of her deposition transcript. The deposition was taken on January 24, 2023, in connection with the lawsuit of Nichols v. The TJX Companies, Inc. Stephanie wants Suzanne to review the deposition and take note of any errors in transcription. Because Stephanie is sending an original copy of the deposition, she wants Suzanne to note any mistakes, errors, misspellings on a separate sheet of paper by page and line and to correct the mistake. Stephanie has arranged to have her secretary type up the changes and Suzanne will have a chance to review them with Stephanie before they are sent to the court reporter. The changes must be received by the court reporter within 30 days, so Suzanne must have her changes done soon. If the changes are not made within 30 days, the right to fix mistakes in the transcript is forfeited and the errors become part of the permanent record. Stephanie asks that the letter request Suzanne to call Stephanie at her convenience, so they can discuss the deposition and the next steps of the case.

Your law firm's address is 876 Main Street, Suite A15, Bedford, MA, 01730. Suzanne's mailing address is 81 North Road, also in Bedford.

The transcript will be sent with the letter. Stephanie asks that you send the letter via Overnight Delivery. (Note: Please see the sample in the book for the content of a letter enclosing a transcript for review).

Letter # 3: Confirming Letter

Your attorney, Annabeth Silver, just got off the phone with opposing counsel, Michael Gold. Annabeth tells you that Mr. Gold agreed to produce his client, Alissa Stevens, for a deposition on March 31, 2023, at 10:00 a.m. at your law office. She also tells you that Mr. Gold has agreed to produce documents at the time of the deposition. Annabeth asks you to send Mr. Gold a confirming letter with a carbon copy to Peter Hickey, another attorney in your office. The matter involves the case of Stevens v. Apple Orchard, Inc. and has an internal reference number of 65313549. The letter will go by facsimile only. Your office address is 321 Main Street, Natick, MA 01760, and the name of your law firm is Silver & Associates. Mr. Gold's law office is called Gold, Diamond & Sapphire, PC, and their address is 987 Gemstone Way, Framingham, MA 01701. The fax number is 508-555-1212.

Letter #4: 93A Demand Letter

You are a paralegal working for the law firm of Sanders & Sanders, LP, which is located at 90 Belkins Way, Suite 400, Peabody, MA 01960. Your supervising attorney is Andrew Sanders. Recently, Sanders & Sanders obtained a new client, Rebecca Stapleton. In November 2021, Rebecca had saved enough money and purchased from Best Buy a new, high efficiency washing machine for $1200. The washing machine came with a one-year warranty, but Rebecca also purchased the extended warranty for an additional $200. The extended warranty plan covers the costs of any new parts needed for the machine, but not the labor cost of any service call.

Rebecca was very excited to use her new machine - no more saving quarters and no more trips to the Laundromat! Unfortunately, on December 2, 2022, during the first time Rebecca used her new washing machine, it did not rinse the soap from her clothes. She had to run the rinse cycle three times to get all the soap out and then hand wring out her clothes to get out the excess water. Since that time, Rebecca has spent money to have Best Buy try to repair the machine, plus expenses to wash her clothes at the Laundromat. After several weeks, the machine broke again and flooded Rebecca's basement. Rebecca now wants to demand of Best Buy that they give her a new machine (enough trying to fix the other one!) and repay her for her Laundromat expenses and the expense of having her basement cleaned.

Thankfully, Rebecca kept great notes of her troubles with Best Buy that will help you draft the demand letter:

December 2022- buy new washing machine from Best Buy, with warranty for $200

12/2/22 - called Best Buy to ask for repair, but cannot come until December 10

12/5/22 - spent $10 at Laundromat to wash clothing

12/10/22 - the Best Buy serviceman came out, but told me he needed another part and would be back in two more weeks. Charged me $75 for service call.

12/15/22 - spent $20 at Laundromat to wash clothing

12/22/22 - Best Buy repairman came out with new part, but charged me $75 for service call

12/25/22- use new machine and it works fine! Very excited

1/3/23 - washing machine breaks again, clothing does not rinse properly. Spend $10 at Laundromat. Call Best Buy for appt.

1/5/23 - serviceman comes out to repair machine - this is the third time! He charges me $75 for service call, but no new parts needed.

1/5/23 - 1/30/2023 - washing machine works great!

1/31/2023 - washing machine does not rinse again, overflows, flooding my basement

2/1/2023 - Pay $500 to cleaning service to dry basement floors

Your assignment is to draft a 93A demand letter to Best Buy - you will need to find the address of their corporate headquarters. You do not yet have the name of a corporate executive to whom we can address the letter. *Please make the letter for Andrew Sanders's signature and a copy to Rebecca. *Please make sure the letter conforms to the requirements of chapter 93A as we discussed in class; you can use the sample 93A letter and the handouts on Blackboard as your guide. NOTE: Do not list her notes in the letter; because this is a business letter the client's notes should be re-framed and drafted as a paragraph.
